Borkovic’s appeal rejected by Court

The International Court of Appeal confirmed the exclusion of Dušan Borković from the second WTCC race of Termas de Río Hondo.

The Appeal had been filed by the Real Federación Española de Automovilismo (RFEA) on behalf of its license holder, Campos Racing, against the exclusion based on the FIA Technical Delegate report in which was said that the ground clearance of the Serbian’s car was not in conformity with article 263.209 of Appendix J of the International Sporting Code.

Borković had finished the second race in Argentina in eight position and the team claimed that the nonconformity of the ground clearance was the consequence of a race incident that resulted in damage to the flat bottom.

After the hearing that took place last Friday, 26 September 2014, at the FIA headquarters in Paris, the Court decided to uphold the decision taken by the Panel of the Stewards because the Appellant failed to provide any convincing evidence that the irregularity was due to the breaking of the flat bottom during the competition.
